1. Who we are

SubletNY is an online marketplace that connects New York City leaseholders who want to sublet their apartments with people looking for short-term housing. We are not a party to any rental agreement between hosts and guests, and we do not own, manage, or control any listed property.

2. Eligibility

You must be at least 18 years old to use SubletNY. By creating an account you represent that you are a legal resident or entity with the authority to enter into binding agreements, and that all information you provide is accurate and up to date.

3. Your account

You are responsible for maintaining the security of your account. Do not share your login credentials. Any action taken from your account is your responsibility. Notify us immediately if you suspect unauthorized access.

4. Listings

Hosts are solely responsible for the accuracy and legality of their listings. By posting a listing you represent that you have the legal right to sublet the property under your lease and applicable New York law, that all information is truthful, and that the apartment will be available as described.

SubletNY may remove any listing that violates these terms, our Community Agreements, or applicable law — without notice and at our sole discretion.

5. Payments and fees

SubletNY does not process payments between hosts and guests. All financial arrangements — including rent, deposits, and refunds — are made directly between the parties. We are not responsible for any financial disputes arising from a sublet arrangement.

6. Prohibited conduct

You may not use SubletNY to: post false or misleading content; scrape, copy, or redistribute listings without our written consent; circumvent, disable, or interfere with security-related features; use the platform to harass, threaten, or discriminate against any person; or violate any applicable law or regulation.

7. Disclaimer of warranties

SubletNY is provided “as is” without warranties of any kind. We do not guarantee the accuracy of listings, the conduct of any host or guest, or the suitability of any apartment. You use the platform at your own risk.

8. Limitation of liability

To the maximum extent permitted by law, SubletNY and its operators will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform or any sublet arrangement facilitated through it.

9. Changes to these terms

We may update these terms from time to time. Continued use of the platform after changes are posted constitutes your acceptance of the revised terms. We will make reasonable efforts to notify users of material changes.

10. Governing law

These terms are governed by the laws of the State of New York, without regard to its conflict-of-law provisions. Any disputes will be resolved in the courts of New York County.
